Constitution of India 'amended' for Sonia Gandhi

When she was most powerful person in India.

Every Congress person holds office as long as he/she enjoys their pleasure

(Was written in June 2005 when there was much noise in media because Prime Minister Dr. Manmohan Singh had gone to the airport to see the Congress President off to Russia. It was published as “letter to the editor” in The Economic Times on June 17, 2005.)

Amendment of Indian Constitution by Sonia Gandhi

To make facto President more important than de jure President in India

There is much noise on the PM going to the airport to see Congress president of Russia and the external affairs Minister accompanying her.

Is it not by now clear that there are some informal, but structural, amendments to Clauses (2) and (3) of Article 75 of the Indian Constitution?

Clause (2) says that “The ministers shall hold office during the pleasure of the President.”

Clause (3) says that “The Council of Ministers shall be collectively responsible to the House of People.”

The informal amendments are:

Proviso to Clau     Clause (2) – “Provided that when there is a government headed by the Congress, ‘President’ means ‘Congress President’.

Proviso to Cla       Clause (3) – “Provided that when there is a government headed by the Congress, ‘House of People’ means ‘Congress President’.
